Welcome to BrickBuilds! The terms “we,” “us,” and “our” refer to BrickBuilds. These Terms of Service (“Terms”) govern your access to and use of our store and website, including all related content, features, products, and services (the “Services”).

By using our Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

We are registered and operate in Croatia. All legal references in these Terms comply with EU consumer protection and e-commerce laws, including the Consumer Rights Directive.

2. Account & Eligibility

  • You must be at least 18 years old (or the age of majority in your country) to use our Services.

  • If you allow a minor dependent to use the Services, you are responsible for their activity.

  • You agree to provide accurate, current, and complete account information and keep your login credentials secure.

  • You may not transfer or sell your account to others.

3. Orders & Contract Formation

  • Orders placed through our store constitute an offer to purchase.

  • Your order is accepted only when we send an order confirmation email.

  • We may decline orders at our discretion (e.g., stock unavailability or pricing errors).

  • All sales are subject to EU consumer laws.

4. Prices, Taxes, and Fees

  • Prices shown include applicable VAT unless stated otherwise.

  • Shipping, handling, customs, or import fees are indicated during checkout.

  • We may run promotions subject to separate terms.

5. Shipping & Delivery

  • Delivery times are estimates.

  • Risk and title pass to you upon delivery.

  • BrickBuilds is not liable for delays caused by carriers, customs, or events beyond our control.

6. Right of Withdrawal (EU Consumers Only)

  • EU consumers have 14 days from delivery to cancel for any reason.

  • Items must be returned in original condition, with tags and packaging.

  • Consumers bear the cost of return shipping unless goods are defective or incorrect.

  • Refunds will be processed within 14 days of receipt of returned items.

Exemptions:

  • Custom or personalized products

  • Perishable goods

  • Digital content downloaded with consent

  • Sale items and gift cards

7. Statutory Warranty (EU Consumers)

  • All goods come with a 2-year legal guarantee against defects or non-conformity.

  • Remedies include repair, replacement, or refund, according to local law.

8. Intellectual Property

  • All content, trademarks, and designs are the property of BrickBuilds or its licensors.

  • Use of our intellectual property for commercial purposes requires written consent.

9. Optional Tools & Third-Party Links

  • Any third-party tools or links are provided “as is”.

  • BrickBuilds is not responsible for third-party content or transactions.

10. Feedback

  • By submitting feedback, you grant BrickBuilds a worldwide, royalty-free license to use it.

  • Feedback must not infringe third-party rights or contain illegal content.

11. Prohibited Conduct

You agree not to:

  • Violate laws or regulations

  • Infringe IP rights or privacy rights

  • Transmit harmful software or spam

  • Misrepresent identity or manipulate the Services

12. Termination

  • We may suspend or terminate your access for violations of these Terms.

  • Certain obligations survive termination (Intellectual Property, Feedback, Liability, Governing Law, Privacy Policy).

13. Disclaimers & Limitation of Liability

  • Services and products are provided “as is”.

  • BrickBuilds is not liable for indirect, incidental, or consequential damages.

  • EU consumer rights (statutory warranty, withdrawal) remain unaffected.

14. Indemnification

You agree to indemnify BrickBuilds and its partners from claims arising from:

  • Your breach of these Terms

  • Violation of law or third-party rights

  • Misuse of the Services

15. Governing Law & Jurisdiction

  • For EU consumers, your local consumer protection law applies, and disputes will be resolved in the courts of your country of residence.

  • For non-EU users, Croatian law governs, and courts in Bjelovar have jurisdiction.

16. Changes to Terms

  • We may update these Terms at any time.

  • Material changes will be communicated per EU law.

  • Continued use constitutes acceptance of updated Terms.
